Ghana Police acted unprofessionally – Lawyer of 5 KOSS murder suspects tell court

The lawyer defending the five juvenile suspects in the murder of a first year student of the Konongo Odumasi Senior High School (KOSS) in the Ashanti region, Richard Adu Darko has taken on the Ghana Police Service for acting unprofessionally and violating the rights of the children.

The legal practitioner told the Konongo Odumasi District Court today that the Ghana Police Service erred in publishing the identification details of the suspects on their official Facebook page, in contravention of the Juvenile Justice Act, 2003, Act 653.

The Ghana Police Service in a November 8, 2021 update on their official Facebook page published the identification details of the suspects, including the names and aliases after the court presided over by Her Ladyship Joyce Bamfo remanded them into police custody for one week in their first court appearance.

Checks by however indicate that the said post has been edited with the identification details of the suspects removed.

All the five suspects who have been provisionally charged with Abetment of Murder, and Murder Contrary to Sections 20 and 46 of the Criminal Offences Act (Act 29) have been returned to juvenile detention after the appeared in court today; they are to reappear on Monday 22 November.

Speaking with journalists this morning, lawyer for suspects, Richard Adu Darko said “the court has taken notice of the violation of the rights of the suspects and because of that the case has been adjourned once again to next week”.

The pleas for the suspects to return to school or to be released into the custody of their families were however not granted by the court and as such they are to remain in the custody of the police under juvenile detention.

The Ghana Police Service has been directed to communicate the matter to the Attorney General’s Office to get a representative to appear in court in order to transfer the case to the high court for trial to commence.
